Joplin is the product name used for this early-access service. These Terms of Service ("Terms") apply when you access the Joplin website, create an account, join the founding pilot, or use a Joplin-hosted customer page. "Joplin," "we," and "us" refer to the team operating the product. Noettic, Inc. is the legal service provider for Joplin. Public signup and account collection remain closed.
1. Agreement and business use
By creating an account or using Joplin, you agree to these Terms and acknowledge the Privacy Policy. If you use Joplin for an organization, you confirm that you are authorized to act for that organization. Joplin is intended for business use and is not directed to children.
2. Founding-pilot status
Joplin is in early access. Features may change, be limited to selected customers, require manual setup, or remain unavailable. A public page may describe a feature or member benefit as planned, waitlist-only, pilot, or controlled rollout. Those labels are part of the offer: a planned feature is not included in your active service unless Joplin confirms it in writing.
Joplin may update, suspend, or discontinue an early-access feature when needed for safety, reliability, provider compatibility, or product direction. When a material change affects a paid founding-pilot commitment, Joplin will communicate the available next steps.
3. Accounts and access
- Provide accurate account and business information.
- Keep sign-in links, passwords, and connected-account access secure.
- Use only accounts, websites, content, lists, and provider connections you are authorized to use.
- Notify Joplin promptly if you suspect unauthorized access.
You are responsible for activity performed through your account until you notify Joplin of a suspected compromise. Joplin may require verification before changing account access or disclosing account information.
4. What Joplin does—and does not promise
Joplin uses the context you provide and available public website evidence to recommend marketing work and prepare plans, drafts, hosted pages, and reports. Unless an exact provider capability is live, connected, authorized, and past the required approval gate, Joplin creates a draft or handoff rather than claiming that work was sent or published.
- Generated work may be incomplete, inaccurate, or unsuitable and requires appropriate human review.
- Joplin does not guarantee customers, leads, revenue, rankings, engagement, return on spend, or any other business outcome.
- Joplin activity, hosted-page activity, connected evidence, and owner-reported outcomes are different kinds of information.
- Joplin is not a substitute for legal, tax, financial, medical, employment, regulatory, or other licensed professional advice.
- You remain responsible for final claims, offer terms, approvals, publishing decisions, and compliance with laws that apply to your business and marketing.
5. Plan requests, payment, and cancellation
During the controlled founding pilot, submitting a plan or waitlist request does not activate paid service and does not authorize a charge. Before any paid service begins, Joplin will confirm the exact plan, included scope, price, billing frequency, start date, cancellation process, and any applicable trial, refund, or credit terms in writing.
Your confirmed order, invoice, or other written pilot arrangement may add commercial terms. If it conflicts with these Terms on the specific price, scope, or billing arrangement, the confirmed written arrangement controls for that subject. Taxes or provider charges may apply only when disclosed in the applicable payment arrangement.
For self-serve subscriptions, the selected monthly or annual fee is charged when checkout is completed and renews automatically at the same interval until canceled. Displayed prices exclude sales, use, value-added, or similar taxes that Joplin is required to collect. You may cancel through the Stripe billing portal before renewal; cancellation takes effect at the end of the current paid period, and access continues until then.
If Joplin is not a fit, you may request a refund of your first subscription payment within 14 days after the initial purchase by emailing support. Renewal charges, partially used billing periods, and third-party charges are otherwise non-refundable, except where applicable law requires a refund. Joplin may issue a discretionary credit when a material service failure prevents use of the paid service.
6. Your content and generated work
You retain your rights in the business information, prompts, uploads, connected-account information, and other content you provide. You give Joplin a limited permission to host, copy, process, and transmit that content as needed to operate the service, follow your instructions, secure the product, and provide support.
As between you and Joplin, Joplin does not claim ownership of your business content or the generated work created for your account. Ownership and exclusivity of AI-generated material can depend on applicable law, source material, and third-party rights. You are responsible for reviewing work before using it and for making sure you have rights to any supplied names, images, testimonials, lists, trademarks, and other materials.
7. Hosted pages, leads, and communications
If you publish a Joplin-hosted page, you are responsible for the offer, claims, form fields, notices, and follow-up communications associated with your business. You must use lead information only for lawful purposes and honor applicable consent, unsubscribe, privacy, and anti-spam requirements. Joplin may provide form protection, storage, export, and supported provider handoffs, but does not become the seller of your offer.
8. Connected services
Connections to email, social, website, AI, billing, or other providers are also governed by those providers' terms and permissions. A connection may support account mapping, lead sync, draft creation, or a handoff without supporting final sending or publishing. Provider availability, APIs, permissions, and policies may change outside Joplin's control.
9. Acceptable use
You may not use Joplin to:
- break the law, violate another person's rights, or market an unlawful offer;
- create deceptive claims, impersonate another person, or conceal required sponsorship or advertising disclosures;
- upload malware, probe or disrupt the service, bypass access or usage limits, or obtain another customer's data;
- send spam or use lists, accounts, or personal information without the necessary permission;
- submit secrets or sensitive information that are not needed for the marketing task; or
- use generated work without the review reasonably required by the subject, industry, audience, and applicable law.
10. Suspension and ending use
Joplin may pause or restrict access to protect customers, investigate suspected abuse, address nonpayment, enforce these Terms, or respond to a provider or legal requirement. You may stop using the service and request cancellation or account deletion by contacting support. Any payment, retention, export, or deletion handling will follow the confirmed pilot arrangement, the Privacy Policy, and applicable law.
11. Early-access warranty and liability boundary
Joplin is provided on an early-access, "as available" basis. To the extent permitted by law, Joplin does not promise uninterrupted access, error-free operation, compatibility with every provider, or that generated work will achieve a particular result. To the extent permitted by law, Joplin and the team operating it are not responsible for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, opportunities, goodwill, or data resulting from use of the service. These Terms do not exclude rights or liability that cannot legally be excluded.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, unless applicable law gives you a non-waivable right to bring it elsewhere. Before filing a claim, each party agrees to give the other written notice and 30 days to try to resolve the matter.
13. Changes and contact
Joplin may update these Terms as the founding pilot changes. Material updates will be posted here with a new effective date and, when appropriate, communicated through the service or account email. Continued use after an update takes effect means the updated Terms apply to later use, except where additional consent is required by law.
